URGENT: The Executive Power Play on Gun Control

Published

on

First a Pandemic and now an “Epidemic!”

The President yesterday announced his aggressive SIX STEP plan on “curbing gun violence”, calling it “an Epidemic that has to stop.

He announced this six step plan which includes tighter rules on buyers of home-assembled “ghost guns” {a new scare tactic term for gun parts without serial numbers} and directing the DOJ to reconstruct their policy on the already 3MIL + sold Pistol stabilizing braces (PSB) and already manufactured firearms equipped with the PSB for certain model firearms like the (AR-15). He also directed them to model “red flag” or ERPO legislation for states; funds for community-based violence intervention; an annual report on firearms trafficking and last but not least the Universal Background Checks expansion.

Biden went on to nominate “an avid gun-control guy” David Chipman to be director of the BATFE. Chipman served as an adviser at Giffords, an advocacy group founded by former Rep. Gabrielle Giffords, who was shot at an Arizona political event in a 2011.

This is an epidemic, for God’s sake,” Biden said. “And it has to stop.”

He called his actions “totally consistent with the Second Amendment.”

Is it Consistent with the Second Amendment?

Not No, but Hell, NO! In fact, when you study this plan in detail it is extremely overreaching for the average law abiding Americans who possess over 390million guns nationwide. Here are some of the reasons why!

  1. Dictating how much ammunition to possess! Read the fine print on this topic.
  2. The expansion of Registering over 3Million firearms with Pistol Stabilizing Braces.
  3. Reframing the definition of “individual gun sales” and “gun show loopholes”.
  4. Incorporating a National “Red Flag Laws” this doesn’t affect the Second Amendment but it damn sure affects the expansion of the fourth amendment. This is alarming.

As we’ve seen over and over again, these measures do nothing to reduce gun violence but they do make people more vulnerable to criminals. People have a right to defend themselves, and the government should have no role in telling people how to do it,”Julie Gunlock, director of the Center for Progress and Innovation stated.

Red Flag Laws- Why this should scare you!

Have you ever heard of someone who had a restraining order on them for some bogus reason and it took them forever to get rid of it, due to a lack of due process or an angry ex lover or horrible neighbor or other family member? Maybe you’ve even seen it in a movie… In my opinion This is the the thought processes behind these overreaching and extremely aggressive Red Flag Laws.

So, here’s why they want to expand the definition of the “Fourth Amendment” which by the way speaks on “Unreasonable Search and Seizures”.  Let’s just say, Bob was overheard arguing with his wife Jane, by their neighbor Sam.  Sam is concerned, he doesn’t know the circumstance and he’s a nosy neighbor anyway, and then he realizes that Bob has an NRA sticker, “Oh, No” he thinks!  Bob, must have guns, and he’s yelling at Jane, I’m concerned that now he may be too angry and he may be a “threat to Jane and my family too”. So, Bob gets a visit from the cops, who come in seize his guns and holds him in jail until it can be sorted out. Bob had a bad day at work and now is in jail due to a nosy neighbor, over reaching laws and a ruined record with no priors and now a destroyed home life.

Now, somehow Bob has to prove his innocence due to this “Preemptive Strike” to thwart crime by a tyrannical government.  Is this a bit far fetched? I don’t think so! Who is to decide that he should have his guns seized, the brand new cop on the scene?

There’s no due process? Of course, even as a prior law enforcement officer, I would want the guns removed first just for scene safety, but what about Bob? Although he had some marital issues that didn’t constitute and domestic violence at all, he is now nearly a felon without having committed a crime due to SUBJECTIVE REASONING AND INTERPRETATION of the law.

Under this “Leaping Logic” as I like to say, nearly anyone can turn anyone in who they think could be a threat! It’s a perfect weapon for ex spouses and bitter friends and family members to cripple a decent citizen. That’s my two cents on that… Bottom line is it may help some but at what is the cost of Freedom to MILLIONS of law abiding Citizens?

Universal Background Checks

Did you know that there is a National Background Check system already in place? It’s called the FBI NICS. This system has been in place for years and every licensed gun dealer across the country MUST use it for EVERY GUN SOLD! If you are 18yrs of age and want to purchase a rifle or shotgun or 21 to purchase a handgun (this is typical in most states like here in Arizona. (Some states are more strict). The point is this disclaimer to the citizenry that guns are being purchased all over the country without background checks is disingenuous and it’s more of the same fear-mongering!

One item I may agree with if I had to give something across the aisle would be for the average joe to do a standard NICS check on guns sold at gun shows.. I am a bit torn when I say that because the Libertarian in me says “NO” to any background checks, and the prior law enforcement side of me says, well, ya never know about some people and a check “MAY” help a bit.

On another note, while I was running Patriot Outdoors in New Mexico for 16+years, we conducted nearly 10-12K background checks in my recollection and out of all of those NICS checks, only 4 turned up to be denials…. Out of those 4 denials, 2 were appealed and were able to purchase their firearms.  What does that tell you? It’s a bad system or maybe just maybe Bad Guys don’t predominately buy guns in legitimate gun stores.

Pistol Stabilizing Braces

What is a Pistol Stabilizing Brace? Well, the  ATF approved such a device in 2013. Since then over 1 million have been manufactured and sold and over 2 million firearms were made incorporating the brace or other variants of it.

Now, with Biden in power, he is so called “weaponizing the ATF” with his liberal agenda and bipartisan appointees to basically go after law abiding citizens who under the law purchased these braces for their guns legally.

By the Way in 2014, the ATF clarified it’s position on PSB’s and said that the brace did not constitute the gun as a Short Barreled Rifle. This was under an Obama Presidency.

Depending on delivery of the law and enforcement could make millions of gun owners felons overnight if they don’t comply with REGISTRATION of their over the counter guns to the NFA and make them Class 3 and pay 200.00 for each brace they have and submit to fingerprints and another background check according to some sources.

for what purpose, now we are saying that due to a few criminal acts all of a sudden millions of gun owners are now affected? How about we enforce the law and throw the book at them for their heinous acts.

“One person’s failure (crime) is not a justification to restrict another person’s liberties!” ~David Bates NH State Representative

The Balance of Freedom & Safety

I am all for safety, I am all for freedom. If you are reading this I can bet that you all are as well. But, we have to have some serious conversations concerning the mentally ill that seem to be trending lately with these heinous acts, but due this with a pragmatic approach to protecting the liberties of the lawful. It is a slippery slope, when we start injecting subjective thinking and “Grey” areas left to interpretation of our daily freedoms.

It is my belief that this is not just a head problem that has caused some of this chaos over the years but a heart problem, a leadership problem, a Virtue Problem. We have allowed our society to embrace so much freedom that we have lost some of our innocence and values that helped create such a beautiful way of American Living.. The Family Unit, The Male Role model for our children and our wives, The Accountability of each other to lift each other up and keep ourselves to standards. It’s okay to be accepting and have tolerance but not so much that we lose our way and with a “laze faire” attitude approach.

Franklin said this:

What Can You Do?

You can get involved and get educated.. Most voters, don’t know who or why they are voting until election day! Do your homework, I know of many who didn’t realize the impact and the negative effect of a Biden administration until now! You have to be intentional in this life that we live. Get involved and remember that “We the People” still exist. We are in control of our Government not the other way around. I’d recommend funding organizations that support your beliefs and way of living, locally, regionally and nationally. It’s time to wake up and smell the coffee and not be apathetic to the leadership in office at any level no matter which side of the aisle you are on!

My Thoughts

I fear if we do not step up and speak out, respectfully, intelligently and persistently, we will remain outspoken and our liberties will be decreased for us, for our children and in ultimately reduce the integrity and stability of our great nation”…SD Powell

Make Universities Accountable for Predatory Student Loan Abuse

Published

on

The Biden administration is still talking about delivering on the President’s promise to relieve student loan debt for many Americans. There is continuing discussion on how much debt should be forgiven, how to pay for it, and whether it is fair to all those who have diligently and painfully worked to already pay off their own student loans. After all, if you’re going to eliminate student debt to buy votes, why just limit it to student debt?

Unfortunately for Biden, according to numerous sources including National Review, the executive branch has no generalized power to forgive any amount of student debt. Even Nancy Pelosi confirmed simply that “the president can’t do it. That’s not even a discussion.” The Department of Education came to the same verdict, determining that the executive branch “does not have the statutory authority to cancel, compromise, discharge, or forgive, on a blanket or mass basis, principal balances of student loans, and/or to materially modify the repayment amounts or terms thereof.”

Of course, even if he had the authority, forgiving student debt doesn’t make the debt go away. Reality has a way of breaking into such “freeloading” dreams. It’s pay me now, or somebody else pay me later. But why should some future taxpayer pay off anyone else’s student debt?

Whatever happened to wise warnings of “student beware.” When you get an education and agree to pay the tuition, you ought to realize that you must at some point pay for that education. You signed on the bottom line. Face your real-world responsibilities. Hopefully, you picked a degree major that will ensure a career capable of paying off your loans. Students clearly have some responsibility, but what about the universities that took advantage of the money coming from those loans?

Trending on PolitiCrossing.com: Tucker: This is a coordinated attack on the family

After all, there is ample evidence that student tuitions exploded far faster than inflation when government funds became readily available for student loans. Complaints of excessive tuition increases by students trapped in their programs tended to be met with a less than caring response—pound sand!

Since 2008, the tuition cost or a four-year college degree has increased nearly 25%. In that same period, student debt has doubled, increasing by 107%. 2015 study found that a dollar of subsidized student loans results in a published tuition increase of 58 cents at a typical university, An NBER paper suggests that changes to federal student loans are more than sufficient to explain tuition increases at private nonprofit colleges. And a 2014 study found that for-profit colleges eligible for federal student aid charged tuition 78% higher than that of similar but aid-ineligible institutions.

In short, there is no doubt that tuition was rising faster than the inflation level. Evidence has been clear for decades. In 1987, Secretary of Education William J. Bennett argued that “increases in financial aid in recent years have enabled colleges and universities to raise their tuition, confident that Federal loan subsidies would help cushion the increase.”

Bennett pointed out in 1987 that federal student aid had risen 57 percent since 1980, while inflation had been 26 percent. A 2020 analysis by the Congressional Budget Office brought the numbers up to date: “Between 1995 and 2017, the balance of outstanding federal student loan debt increased more than sevenfold, from $187 billion to $1.4 trillion (in 2017 dollars).” What is the lesson? The more federal aid to students is available colleges raise tuition more. Salaries rise and bureaucracies expand. There are more courses, more dorms, dining halls, lavish recreational centers, and more money for endowments.

Far too many students find that once they begin their education, their schools raise the tuition at such a high rate that their debt explodes. The university builds their endowment, and the “trapped” student is compelled to finish what they started at a cost they did not expect to have to pay. In such a situation, should not the university be responsible for any increased cost above the increase in cost of living during the same time? It’s time for universities to take responsibility for their share of student debt.

The universities that benefited from these loans should have a part in footing the bill. That means universities that raked in millions to inflate endowments should be holding the bag for those who can’t afford to pay their loans. With universities holding hundreds of billions of dollars in tax-free endowments, any government program to relieve student debt should be completely dependent on taxing those university endowments.

It’s time to counter the Democrats’ vote-buying scheme by making lasting changes to the student loan process. That means putting universities on the hook for their predatory behavior. That will go much further than a temporary payoff that does nothing to solve what is causing the problem.

Tucker: Why are they so angry?

There’s no Constitutional requirement to have respect for anybody in the US government. In fact, in a free country you are encouraged to disagree. You are a citizen, you have that inherent right. But, no more.

Published

on

Tucker gives an extended list of several people who were arrested or had their homes raided, without explanation, for no crime. Highlights include:

“Why have a political debate when you can just arrest people who disagree with you? And that has happened, far below the media radar since the day Joe Biden was elected, and tonight we want to show you … a litany, a list of Americans who have been arrested, detained by federal law enforcement on the orders of the Biden administration, not because they committed recognizable crimes but because they disagreed with the political aims of the Biden administration.”

“Ooh, Trumps a fascist, remember that? Did Trump’s DOJ raid the homes of a lot of journalists who embarrassed his children? No, you don’t remember that, because it didn’t happen. But Joe Biden’s justice department has done that, and then they kept going.”

“We don’t arrest people for ignoring congressional subpoenas, especially when they cite executive privilege, a principal that has a long history in American history, so no, we’ve never done that, but we can do it now because it was ‘an insurrection’, an insurrection that wasn’t armed, wasn’t planned, it didn’t actually insurrect anything, but it was still an insurrection. Now you’re beginning to see why it’s been so important from the very first day for the media to describe what happened on January 6 not as a riot, but as an insurrection, because if it’s an insurrection, they can violate your civil rights.”

“So, a decade ago the Obama administration was caught sending automatic weapons to Mexican drug cartels and Congress wanted to know more about this. Eric Holder, then the attorney general, had a key role in this, ‘operation fast and furious’, you may remember it. So, they subpoena’d him, and he ignored the subpoena, and the media applauded, he was taking a noble position. But when Steve Bannon or Peter Navarro tried to do something like that, they went to jail. Again, we had this exact same thing happen in public ten years ago. A federal judge ruled that Holder’s privilege claim was not legitimate, and he was still never arrested, but the rules have changed. Why is that?”

“There’s no Constitutional requirement to have respect for anybody in the US government. In fact, in a free country you are encouraged to disagree. You are a citizen, you have that inherent right. But, no more. The media think you should be sent to jail if you show disrespect, and so of course, with no media to push back against unconstitutional overreach, the justice department kept going.”
