URGENT: The Executive Power Play on Gun Control

First a Pandemic and now an “Epidemic!”

The President yesterday announced his aggressive SIX STEP plan on “curbing gun violence”, calling it “an Epidemic that has to stop.

He announced this six step plan which includes tighter rules on buyers of home-assembled “ghost guns” {a new scare tactic term for gun parts without serial numbers} and directing the DOJ to reconstruct their policy on the already 3MIL + sold Pistol stabilizing braces (PSB) and already manufactured firearms equipped with the PSB for certain model firearms like the (AR-15). He also directed them to model “red flag” or ERPO legislation for states; funds for community-based violence intervention; an annual report on firearms trafficking and last but not least the Universal Background Checks expansion.

Biden went on to nominate “an avid gun-control guy” David Chipman to be director of the BATFE. Chipman served as an adviser at Giffords, an advocacy group founded by former Rep. Gabrielle Giffords, who was shot at an Arizona political event in a 2011.

This is an epidemic, for God’s sake,” Biden said. “And it has to stop.”

He called his actions “totally consistent with the Second Amendment.”

Is it Consistent with the Second Amendment?

Not No, but Hell, NO! In fact, when you study this plan in detail it is extremely overreaching for the average law abiding Americans who possess over 390million guns nationwide. Here are some of the reasons why!

  1. Dictating how much ammunition to possess! Read the fine print on this topic.
  2. The expansion of Registering over 3Million firearms with Pistol Stabilizing Braces.
  3. Reframing the definition of “individual gun sales” and “gun show loopholes”.
  4. Incorporating a National “Red Flag Laws” this doesn’t affect the Second Amendment but it damn sure affects the expansion of the fourth amendment. This is alarming.

As we’ve seen over and over again, these measures do nothing to reduce gun violence but they do make people more vulnerable to criminals. People have a right to defend themselves, and the government should have no role in telling people how to do it,”Julie Gunlock, director of the Center for Progress and Innovation stated.

Red Flag Laws- Why this should scare you!

Have you ever heard of someone who had a restraining order on them for some bogus reason and it took them forever to get rid of it, due to a lack of due process or an angry ex lover or horrible neighbor or other family member? Maybe you’ve even seen it in a movie… In my opinion This is the the thought processes behind these overreaching and extremely aggressive Red Flag Laws.

So, here’s why they want to expand the definition of the “Fourth Amendment” which by the way speaks on “Unreasonable Search and Seizures”.  Let’s just say, Bob was overheard arguing with his wife Jane, by their neighbor Sam.  Sam is concerned, he doesn’t know the circumstance and he’s a nosy neighbor anyway, and then he realizes that Bob has an NRA sticker, “Oh, No” he thinks!  Bob, must have guns, and he’s yelling at Jane, I’m concerned that now he may be too angry and he may be a “threat to Jane and my family too”. So, Bob gets a visit from the cops, who come in seize his guns and holds him in jail until it can be sorted out. Bob had a bad day at work and now is in jail due to a nosy neighbor, over reaching laws and a ruined record with no priors and now a destroyed home life.

Now, somehow Bob has to prove his innocence due to this “Preemptive Strike” to thwart crime by a tyrannical government.  Is this a bit far fetched? I don’t think so! Who is to decide that he should have his guns seized, the brand new cop on the scene?

There’s no due process? Of course, even as a prior law enforcement officer, I would want the guns removed first just for scene safety, but what about Bob? Although he had some marital issues that didn’t constitute and domestic violence at all, he is now nearly a felon without having committed a crime due to SUBJECTIVE REASONING AND INTERPRETATION of the law.

Under this “Leaping Logic” as I like to say, nearly anyone can turn anyone in who they think could be a threat! It’s a perfect weapon for ex spouses and bitter friends and family members to cripple a decent citizen. That’s my two cents on that… Bottom line is it may help some but at what is the cost of Freedom to MILLIONS of law abiding Citizens?

Universal Background Checks

Did you know that there is a National Background Check system already in place? It’s called the FBI NICS. This system has been in place for years and every licensed gun dealer across the country MUST use it for EVERY GUN SOLD! If you are 18yrs of age and want to purchase a rifle or shotgun or 21 to purchase a handgun (this is typical in most states like here in Arizona. (Some states are more strict). The point is this disclaimer to the citizenry that guns are being purchased all over the country without background checks is disingenuous and it’s more of the same fear-mongering!

One item I may agree with if I had to give something across the aisle would be for the average joe to do a standard NICS check on guns sold at gun shows.. I am a bit torn when I say that because the Libertarian in me says “NO” to any background checks, and the prior law enforcement side of me says, well, ya never know about some people and a check “MAY” help a bit.

On another note, while I was running Patriot Outdoors in New Mexico for 16+years, we conducted nearly 10-12K background checks in my recollection and out of all of those NICS checks, only 4 turned up to be denials…. Out of those 4 denials, 2 were appealed and were able to purchase their firearms.  What does that tell you? It’s a bad system or maybe just maybe Bad Guys don’t predominately buy guns in legitimate gun stores.

Pistol Stabilizing Braces

What is a Pistol Stabilizing Brace? Well, the  ATF approved such a device in 2013. Since then over 1 million have been manufactured and sold and over 2 million firearms were made incorporating the brace or other variants of it.

Now, with Biden in power, he is so called “weaponizing the ATF” with his liberal agenda and bipartisan appointees to basically go after law abiding citizens who under the law purchased these braces for their guns legally.

By the Way in 2014, the ATF clarified it’s position on PSB’s and said that the brace did not constitute the gun as a Short Barreled Rifle. This was under an Obama Presidency.

Depending on delivery of the law and enforcement could make millions of gun owners felons overnight if they don’t comply with REGISTRATION of their over the counter guns to the NFA and make them Class 3 and pay 200.00 for each brace they have and submit to fingerprints and another background check according to some sources.

for what purpose, now we are saying that due to a few criminal acts all of a sudden millions of gun owners are now affected?How about we enforce the law and throw the book at them for their heinous acts.

The Balance of Freedom & Safety

I am all for safety, I am all for freedom. If you are reading this I can bet that you all are as well. But, we have to have some serious conversations concerning the mentally ill that seem to be trending lately with these heinous acts, but due this with a pragmatic approach to protecting the liberties of the lawful. It is a slippery slope, when we start injecting subjective thinking and “Grey” areas left to interpretation of our daily freedoms.

It is my belief that this is not just a head problem that has caused some of this chaos over the years but a heart problem, a leadership problem, a Virtue Problem. We have allowed our society to embrace so much freedom that we have lost some of our innocence and values that helped create such a beautiful way of American Living.. The Family Unit, The Male Role model for our children and our wives, The Accountability of each other to lift each other up and keep ourselves to standards. It’s okay to be accepting and have tolerance but not so much that we lose our way and with a “laze faire” attitude approach.

What Can You Do?

You can get involved and get educated.. Most voters, don’t know who or why they are voting until election day! Do your homework, I know of many who didn’t realize the impact and the negative effect of a Biden administration until now! You have to be intentional in this life that we live. Get involved and remember that “We the People” still exist. We are in control of our Government not the other way around. I’d recommend funding organizations that support your beliefs and way of living, locally, regionally and nationally. It’s time to wake up and smell the coffee and not be apathetic to the leadership in office at any level no matter which side of the aisle you are on!

Sowing the Wind and Reaping the Whirlwind: California and its Epic Wildfires

Like the 2018 Camp Fire, California’s Dixie Fire is epic. It has burned more than 220,000 acres and at least 40 structures. It’s the largest conflagration since the Camp Fire that destroyed Paradise. Sadly, California wildfires are becoming as common as Florida hurricanes. Why is this happening and who’s to blame? In a word, California.

By mismanaging its forests and water sources and enabling a power provider to place profits over people, the Golden State has sown the wind and is reaping the whirlwind.

Why is every California fire season scarier and more destructive than the last? The reasons can be boiled down to these:

Forest mismanagement

We live five miles from the southeastern edge of the Dixie Fire. Our little mountain town of Quincy is under an evacuation warning. Many of our fellow residents live in areas of mandatory evacuation and some have lost their homes. Local firefighters and forest experts have known for years this was inevitable.

It’s common sense, really. When forest undergrowth and dead limbs and logs are allowed to pile up between trees, you may as well stack logs at their bases and light a match. Wise forest managers remove forest floor fuels and keep forests from growing dangerously dense.

Foolish forest managers allow undergrowth to flourish in order to “protect” ecological environments of certain species at the expense of overall forest ecology. This hands-off approach is pushed in Sacramento by those who think we’re only one species sharing our environment rather than caretakers of our environment.

Wise gardeners prevent weeds from diverting moisture from produce plants by removing them. This ensures a healthy garden. Why wouldn’t smart forest management include removal of undergrowth and dead or dying trees?

Water diversion

A few years ago, state biologists “gill-netted” vast quantities of fish in our local Silver Lake in order to prevent them from feeding on a certain frog. This decimated the fish population in favor of the frog population. How is this an ecological balance?

Similarly, allowing natural water sources to feed rivers and streams provides better hydration for trees—and raises critical moisture levels for forests. Diverting water from Northern California sources when levels are low exacerbates the deadly dryness of moisture-starved Sierra forests. Shouldn’t there be a better balance based on water levels?

As climate change continues to affect moisture and heat, smart and balanced water management becomes more critical. Yet California continues to base policy decisions reactively rather than proactively. If Northern California watershed areas burn for lack of moisture, poor water management will be partially to blame.

So will California’s reliance on hydroelectric power over traditional (and more effective) fossil-fuel plants. The state gets nearly 2/3 of its power from non-fossil fuel production, which is why it has to buy electricity from states like Oregon, Arizona and others.

Failing PG&E

Failed PG&E power lines are responsible for devastating California wildfires for the last five fire seasons. According to PG&E’s initial report the day the Dixie Fire started, an employee responding to an outage noticed a blown fuse at Cresta Dam in a heavily forested area of Butte County around the Feather River Canyon. He found two blown fuses and a tree leaning on a power conductor. He also found a fire on the ground near the base of the tree.

When the 2018 Camp Fire erupted, a PG&E employee noticed flames caused by a faulty transmission line in Feather River Canyon. Many of these lines are supported by electrical towers from the early 1900s. PG&E customers pay modern rates for modern electricity delivered via century-old towers.

In fairness, PG&E is finally taking steps to modernize its infrastructure with underground line burial and other measures. Sadly, these measures are long overdue and are too little too late for victims of the Camp Fire and now for those dealing with the Dixie Fire. Worse, PG&E seems to be continuing their foot-dragging regarding reporting system failures when they point to a wildfire start.

Closed market

According to the California Public Utilities Commission (CPUC), PG&E ignored regulations that require it to report wildfire-related infrastructure failures within two hours of the event. PG&E took five days to report the Dixie Fire-related failure to CPUC. As a state agency, CPUC answers to Governor Gavin Newsom and Sacramento politicians. PG&E is supposed to answer to CPUC, yet is still failing to follow the rules.

Not only is there a lack of meaningful accountability, the relationship between California and PG&E is dysfunctional. The average citizen wonders why Sacramento continues enabling a repeat offender of a power company. Another question is why California refuses to open up its utility market to competitors in order to force PG&E to modernize its infrastructure.

Something has to change or California will continue to burn every fire season. Close to home, people in our community love living in Northern California, but the Golden State will lose even more citizens if residents have to flee the flames every summer.
